The Lawsuits - What You Can Do

4-smiling-people.jpg

We'll fight the fight, but we need your support!

Fighting the Rohnert Park casino proposed by the Federated Indians of Graton Rancheria will require TWO seperate legal actions:  one to challenge the land to trust decision, and one to challenge the Environmental Impact Statement (EIS) due to be released in approximately late Summer.

The land to trust lawsuit was filed on June 6, 2008, in the Ninth District Federal Court, against Secretary of the Interior Dirk Kempthorne, the Bureau of Indian Affairs, and individual BIA officials.  The challenge to the EIS cannot be filed until the Final EIS is approved by the National Indian Gaming Commission.

STC101's LAWSUIT STOPPED LAND TO TRUST DECISION IN ITS TRACKS!!   The decision by the Bureau of Indian Affairs (BIA) to place 254 acres outside Rohnert Park into trust for the Federated Indians of Graton Rancheria has been put hold hold by the lawsuit filed in the federal court on June 6, 2008. The land CANNOT and WILL NOT be placed into trust until the court battle has played out, something that normally takes years.  In the meantime, the 254 acres will remain under state and local jurisdiction, subject to state and local law!  HELP US CONTINUE THE FIGHT!  DONATE TO OUR LEGAL FUND

Since we filed our lawsuit,
New York State, Madison County, NY and Oneida County, NY,  and the towns of Vernon and Verona have joined the Attorneys General of 22 states who have all filed lawsuits challenging the right of the Secretary of the Interior to remove land from a state's sovereign control in order to place the land into trust for a Native American tribe.  The language in the all the lawsuits are often identical to the language in our lawsuit.   Read more....Press coverage....
